انعقاد الزواج بوسائل الاتصال الحديثة "دراسة فقهية قانونية مقاربة"

Abstract

ملخــص رسالة الماجستير المعنونة بـ "انعقاد الزواج بوسائل الاتصال الحديثة" دراسة فقهية قانونية مقاربة الحمد لله رب العالمين، والصلاة والسلام على أشرف الخلق أجمعين، سيدنا محمد وعلى آله وصحبه الطيبين الطاهرين. أما بعد: فإن مسألة التعاقد بوسائل الاتصال الحديثة تكنلوجياً على اختلاف أنواعها "كتابية وسمعية وسمع بصرية" تعد من المسائل التي دعت الضرورة إلى بيانها واختلف الفقهاء في شأنها. وقد رأى الباحث أن يجعل هذه المسألة موضوع رسالته التي أعدها لنيل درجة الماجستير تحت عنوان "انعقاد الزواج بوسائل الاتصال الحديثة"،وأن يساهم ولو بالقليل في جمع ما أمكن من المعلومات حول هذا النوع من العقود. حيث تهدف هذه الدراسة إلى بيان إبراز رأي الفقه الإسلامي بخصوص المسائل التي ظهرت نتيجة لاستخدام وسائل الاتصال الحديثة في إبرام العقود، وبيان أن الشريعة الإسلامية صالحة لكل زمان ومكان، وأنها تواكب مستجدات العصر، كما أنها تهدف إلى بيان حكم إجراء عقد الزواج وإيقاع الطلاق والخلع واللعان بوسائل الاتصال الحديثة، التي تعد هي الإشكالية التي يجاب عنها خلال هذه الدراسة. وكَوْن أن الدراسة في هذا الموضوع تتطرق لمسائل تتعلق بجانب حيوي من حياة المسلمين اليومية، كان لزاما على الباحث أن يَعرض آراء المعاصرين حول هذه المسألة وأن يستسقي ما قيل حولها، لأن كثرة إبرام العقود عبر وسائل الاتصال الحديثة، قد وصل عدد المتعاملين بها إلى الملايين، وكذلك أيضاً أنَّ الأموال التي تُـنفق في هذا المجال كثيرة، مما لا يدع مجالاً للشك للبحث عن الأحكام الشرعية والقانونية لمثل هذا النوع من العقود. لذلك فإن الباحث قد قسّم بحثه إلى فصلين: فصلٌ بيَّن فيه الزواج وعقده بوسائل الاتصال الحديثة، متطرِّقا فيه إلى بيانمفهوم الزواج، وحكم إجراءه بوسائل الاتصال الحديثة، وفصلٌ بيَّن فيه إنهاء عقد الزواج بالطلاق والخلع واللعان وحكم إجرائهم وسائل الاتصال الحديثة. وقد تبع ذلك كله خاتمةً استخلصت أهم ما أفضى إليه البحث من نتائج،وتقديم مقترحات فيما يتعلق بهذا الموضوع. ومن بين هذه النتائج التي توصل إليها الباحث: جواز إجراء عقد الزواج بوسائل الاتصال الحديثة بين الغائبين مشافهة، إذ العاقدان غائبان بأشخاصهما، ولكنهما يعقدان عقد الحاضرين؛ لأنه قد ظهرت فعلًا بعض الوسائل التي تمكن المتعاقدين بأن يروا بعضهم عبر شبكة الإنترنت، أو عبر الهاتف الذي يُظهر صورة كل من المتحادثين مع وجود المحرم، كما أنه في تلك الوسائل هناك الشاهدين اللذين يعرفان المتعاقدين، وكذلك جواز وقوع الطلاق والخلع بوسائل الاتصال الحديثة، وعدم جواز التلاعن بهذه الوسائل. وبعد عرض الباحث لبعض النتائج التي توصل إليها في بحثه، يوصي بأن تتضافر الجهود بصدق وإخلاص وجِد، لمزيد من البحث والمعالجة لمثل هذه الأمور المستحدثة، ابتغاء مرضاة الله عز وجل، وتحقيقاً للتلاؤم مع متطلبات العصر ومقتضيات التطور، وكذلك يجب أن تراعى الضوابط الشرعية، في أي طريقةلإبرام عقد الزواج وإنهائه. Abstract of master’s degree thesis on “Marriage contract by modern communication channels” Jurisprudence and legal studies

Many thanks to Allah, and prayers and peace be upon the most honorable of all creations, Our prophetMuhammad, and his companions. Firstly,writing a contract using modern communications technology of all kinds such as writing, listening or video calls is an issue that needs to be stated and differedby scholars. The researcher saw that this issue should be the subject of his master's degree thesis titled"Marriage by modern communication channels.” andcontribute even a little to collect of as much information as possible about this typeof contracts. This study aims to highlight the opinion of Islamic jurisprudence regarding the issues that have emerged as a result of the use of modern communication channels in concluding contracts,andto show that Islamic law is valid for all time and place, and that it keeps pace with the developments of thetimes,as well as to indicate the ruling on the procedure of the marriage contract, divorce, and other marriage related issues by modern communication channels, which is the problem thatis answered during this study. Since this study deals with issues related to an important aspect of the daily lives of Muslims,the researcherhad to present the opinions of contemporaries onthisissue andtobe consistent with what was saidabout it, because the frequent of thesecontracts using modern communication channels has reached millions, as well as the funds that tunnel in this area is many,leaving no doubtto look for the legal and Islamic way to conclude this type of contracts. Therefore, the researcher divided his research into two chapters: the first chapter talked about using modern communication tricknology to conclude marriage contracts, explaining in depth of the concept of marriage, and the ruling onconducting it by modern communication channels. The second chapter focused on the termination of the marriage contract with all types divorce, and the ruling on conducting it by modern communication technology. In the end, it was followed by a conclusion that extracted the most important results of the research and made proposals related to the mentioned subject. Among these findings, the researcher found: the marriage may be conducted by modern communication channels between the absent verbally, as the disabled are absent in their persons. However, they hold the contract of the attendees because there have already emerged some means that enable contractors to see each other over the Internet, or by telephone that shows the image of each person with the presence of the guardian. In addition to those means,two witnesses who know the contractors. This rule also applies to the divorce. However, it does not apply to accusation. Finally, after presentingsome of the findings in theresearch, the researcher recommends that the efforts be joined sincerely for further research and treatment of such new things, in order to seek the satisfaction of Allah Almighty, and to achieve compatibility with the requirements of the times and the requirements of development, as well as must take into account the legal controls, in any way to conclude or end the marriage contract.
