Abstract

المستخلص تهدف هذه الدراسة إلى إلقاء الضوء على المشكلات المتعلقة بتحديد الحدود البحرية للدول الساحلية، متخذين لهذه الدراسة مناطق أعالي البحار والمناطق الخالصة الاقتصادية والدولية، كما عكفت الباحثة على دراسة المنطقة المتاخمة، وما لهذه الدول من حقوق وواجبات في هذه المناطق بناء على ما جاء في اتفاقيتي جنيف 1958م واتفاقية الأمم المتحدة لعام 1982م من حيث طبيعة هذه المناطق القانونية وحقوق الدول وواجباتها في ضوء القانون البحري والأعراف الدولية السائدة . وقد حظي هذا الموضوع مؤخّرًا على أهمية كبيرة في الأوساط الدولية، لأنه أصبح سببا لكثير من النزاعات الدولية الحالية، ما يمكن أن يثير عديد المشكلات التي تهد الأمن والسلام الدوليين، وما قد ينتج عن ذلك من أثار اقتصادية وسياسية مهمة. يعدّ هذا الفرع من فروع القانون الدولي العام ذا أهمية بالغة، الأمر الذي دفعني وشجعني على اختيار هذا الموضوع ( امتداد سيادة الدولة على البحر العالي ) الذي نشاهد مظاهره اليوم في ترسيم الحدود بين الكثير من الدول في أعالي البحار، خاصة الدول الكبرى التي تمتلك من التقنيات ما يمكنها من استغلال ثرواتها. حيث ستتركز الدراسة على المشكلات المتعلقة بامتداد سيادة الدولة على أعالي البحار، وستتم معالجة هذا الموضوع في فصلين كما ستوضحه الباحثة في دراستها، ويتعلق الفصل الأول بدراسة ماهية البحر العالي ومفهومه وتعريفه، وتحديد طبيعته القانونية وفقا لاتفاقية جنيف 1958م، واتفاقية قانون البحار لعام 1982م، ومن ثم دراسة المنطقة المتاخمة، والمنطقة الاقتصادية الخالصة، مستعرضة في الفصل الثاني ماهية المنطقة الدولية مفهوما وتعريفا، وطبيعتها القانونية والمبادئ الدولية التي تحكمها، وشملت الدراسة أيضًا الحقوق والقيود المقررة للدول في المنطقة، والسلطة الدولية لقاع البحار ودورها في المنطق، إضافة إلى وظائفها ونظام استغلال مواردها. وأخيرا أرفقت ما انتهت إليه الدراسة بخاتمة ونتائج وتوصيات توصلت إليها من خلال دراستي هذه، والله ولي التوفيق. Abstract: This study aims to shed light on the problems related to defining the maritime borders of coastal states, taking for this study the areas of the high seas and the exclusive economic and international zones. The researcher has also been studying the contiguous area, and the rights and duties of these countries in these areas based on what was stated in the Genev Conventions. 1958 and the 1982 United Nations Convention in terms of the nature of these legal areas and the rights and duties of states in the light of maritime law and prevailing international norms. This topic has recently gained great importance in international circles, because it has become the cause of many current international conflicts, which can raise many problems that threaten international peace and security, and the important economic and political effects that may result from this. This branch of public international law is of great importance, which prompted and encouraged me to choose this topic (the extension of state sovereignty over the high sea), whose manifestations we see today in the demarcation of borders between many countries on the high seas, especially the major countries that possess technology How can they use their wealth? Where the study will focus on the problems related to the extension of the state’s sovereignty over the high seas, and this topic will be addressed in two chapters as the researcher will explain in her study, and the first chapter is related to studying the nature, concept and definition of the high sea, and determining its legal nature in accordance with the 1958 Geneva Convention and the 1982 Convention on the Law of the Sea, and from Then the study of the contiguous zone and the exclusive economic zone, reviewing in the second chapter what the international zone is, concept and definition, its legal nature and the international principles that govern it. The study also included the rights and restrictions established for states in the zone, the International Seabed Authority and its role in the logic, in addition to its functions and the system for exploiting its resources. Finally, I attached what the study concluded with a conclusion, results and recommendations that I reached through this study, and God is the Grantor of success>
